What Is the E-2 Treaty Investor Visa?
The E-2 Treaty Investor visa is a non-immigrant US visa category available to nationals of countries with a Bilateral Investment Treaty (BIT) or Treaty of Friendship, Commerce and Navigation (FCN) with the United States that includes E-2 provisions.
The E-2 visa allows the treaty investor to:
- Enter and reside in the United States
- Work in and manage the business in which the investment is made
- Bring a spouse (who may apply for work authorization) and unmarried children under 21
- Renew the visa indefinitely as long as the investment enterprise continues
E-2 Requirements
To qualify for an E-2 visa, the Grenada citizen must:
Be a national of Grenada: the applicant must hold Grenada citizenship (not just a passport — actual citizenship) in good faith, with genuine Grenada ties. The US Embassy scrutinises "treaty shopping" arrangements where citizenship was acquired solely to access the E-2 visa.
Make a substantial investment: the investment must be "substantial" in relation to the total cost of establishing or purchasing the enterprise. The US Embassy uses the proportionality test:
- Enterprises costing under USD 100,000: investment should be close to 100%
- Enterprises costing USD 100,000–500,000: investment should be at least 75%
- Enterprises costing over USD 500,000: investment may be as low as 50% (but must still demonstrate "at risk" commitment)
- Minimum investment thresholds discussed in embassy guidance: generally USD 100,000+ for most commercial enterprises
Investment must be "at risk": the investment must be irrevocably committed to the enterprise; it cannot be a refundable deposit or escrow
Investment must not be marginal: the enterprise must generate income significantly above the minimum necessary to support the investor's family, or have significant growth potential to create US jobs
Investor must be in control: the E-2 applicant must own at least 50% of the enterprise or have operational control

After Grenada citizenship is obtained, the E-2 process involves:
